2. Products & Services
- Flowerpot Packaging provides custom packaging solutions for businesses in cannabis, wellness, lifestyle, and related industries.
- All packaging is subject to customization, lead times, and minimum order quantities (MOQs).
- Product images, mockups, and renderings are for illustrative purposes only. Actual products may vary slightly in color, finish, or design.
3. Quotes, Orders & Payment
- All pricing and quotes are based on client specifications, MOQs, and shipping requirements.
- Quotes are valid for a limited period (as specified in your quote).
- A deposit may be required to begin production, with the balance due before delivery unless otherwise agreed.
- Payments must be made in U.S. dollars by approved payment methods.
4. Shipping & Delivery
- Shipping timelines will be provided at the time of order but are subject to factors outside our control, including customs, tariffs, and carrier delays.
- Risk of loss transfers to the client upon shipment.
- We are not liable for delays caused by force majeure events (natural disasters, strikes, supply chain interruptions, government actions, etc.).
5. Returns & Cancellations
- Due to the custom nature of our products, all sales are final.
- Cancellations may be permitted only if production has not yet commenced, and cancellation fees may apply.
- If an item is defective due to our error, we will work with you to provide a replacement or credit.
6. Intellectual Property
- All artwork, logos, and branding provided by clients remain the property of the client.
- Flowerpot Packaging retains rights to all original dielines, designs, mockups, and renderings unless otherwise agreed in writing.
- You are responsible for ensuring that all submitted designs do not infringe on third-party rights.
7. Compliance & Legal Use
- It is the client’s responsibility to ensure packaging and labeling comply with all applicable federal, state, and local regulations in their jurisdiction.
- Flowerpot Packaging is not liable for compliance issues arising from client-provided artwork, product claims, or labeling content.
8. Limitation of Liability
- To the fullest extent permitted by law, Flowerpot Packaging, LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
- Our maximum liability shall not exceed the total amount paid by you for the specific order in dispute.
9. Indemnification
You agree to indemnify and hold harmless Flowerpot Packaging, LLC, its officers, employees, and partners from any claims, damages, or expenses (including legal fees) arising out of your use of our products, services, or website.
10. Governing Law
These Terms and Conditions shall be governed by and construed under the laws of the State of New York, USA, without regard to conflict of law principles.
